1. Introduction & Agreement to Terms

These Terms and Conditions (“Terms”) govern the purchase and use of products from PLURY USA LLC (“PLURY,” “we,” “our,” or “us”). By creating an account, placing an order, or using our website at www.pluryusa.com, you (“Customer,” “you”) agree to be bound by these Terms.
 If you do not agree, you may not create an account or purchase products.

These Terms are intended exclusively for business-to-business (B2B) transactions. Our products are not sold to individual consumers for personal use.

2. Eligibility

  • You must be a licensed professional, authorized distributor, or business entity engaged in professional cosmetic services.
  • We reserve the right to request proof of eligibility at any time and to reject or terminate accounts that do not meet these criteria.

3. Account Registration

  • Customers must create an account before placing an order.
  • You agree to provide accurate, complete, and up-to-date information.
  • PLURY reserves the right to suspend or terminate accounts at its sole discretion if false or misleading information is provided, or if account use violates these Terms.

4. Products & Professional Use Disclaimer

All PLURY products are intended for professional use only. By purchasing, you confirm that:

  • You are qualified and trained to use the products in a professional setting.
  • You will not resell, distribute, or apply the products outside their intended professional context.
     PLURY is not responsible for any harm, damage, or claims arising from misuse, off-label use, or use by unqualified individuals.

5. Pricing, Payment & Taxes

  • All prices are listed in U.S. Dollars (USD).
  • Accepted payment methods: Link by Stripe, Credit Card, Debit Card, Apple Pay, Google Pay, ACH Direct Debit.
  • Applicable taxes are calculated and displayed at checkout and are invoiced separately from the product price.
  • Payment is due in full at the time of order placement. Orders will not be processed until payment has cleared.

6. Shipping & Delivery

  • We currently ship only within the United States.
  • Shipping methods: USPS Priority Mail (complimentary) or USPS Priority Mail Express (paid by Customer).
  • All shipments require signature upon delivery.
  • PLURY follows best practices for secure packaging and tracking to ensure safe delivery.
  • Risk of Loss: Title and risk of loss pass to the Customer upon PLURY’s delivery of the products to the carrier. PLURY is not responsible for lost, delayed, or damaged shipments after transfer to the carrier. Customers are encouraged to inspect packages upon delivery and file claims with USPS for any transit issues.

7. Returns & Complaints

All returns and complaints are handled in accordance with our separate Returns & Complaint Policy, available at: [Insert Link].
 This Policy forms part of these Terms by reference.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  • PLURY’s liability for any claim arising from or relating to the products shall not exceed the purchase price of the affected product(s).
  • PLURY shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to lost profits or business interruption.

9. Intellectual Property

All content on PLURY’s website, including product images, descriptions, logos, and designs, is the exclusive property of PLURY or its licensors and is protected by applicable intellectual property laws. Unauthorized use is prohibited.

10. Prohibited Uses

You agree not to:

  • Use the products for any unlawful, unsafe, or unauthorized purposes.
  • Misrepresent the products or your affiliation with PLURY.
  • Reverse-engineer, alter, or repackage products without prior written consent from PLURY.

11. Governing Law & Dispute Resolution

  • These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of laws principles.

     

  • In the event of a dispute, the parties agree to first attempt to resolve the matter through good-faith informal negotiations for at least 30 days.

     

  • If unresolved, any legal action must be brought exclusively in the state or federal courts located in Delaware, and the parties consent to personal jurisdiction in those courts.

12. Modifications to Terms

PLURY reserves the right to update or modify these Terms at any time without prior notice. The date of the latest revision will be indicated at the top of this page. Continued use of your account or placement of orders after any modifications constitutes acceptance of the updated Terms.
